Healthy Humans Terms and Conditions
1. The Site and the Services
Please read these Terms of Service (the “Terms of Service”) carefully as they apply to each person’s (“user,” “you” or “your”) access to and use of this web site at www.healthyhumans.com (the “Site”) and the services provided through the Site (the “Services”) by Healthy Humans, LLC (“Healthy Humans,” we,” “our” or “us”).
2. These Terms of Service Bind You and Healthy Humans
BY USING THIS SITE OR REQUESTING ANY SERVICES (E.G., BY OPENING AN ACCOUNT), YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE, THE PRIVACY POLICY, AND ANY OTHER POLICY OR STATEMENT THAT WE POST ON THE SITE.
ANY VIOLATION OF THESE TERMS OF SERVICE OR ANY OF OUR POLICIES MAY RESULT IN THE SUSPENSION OR TERMINATION OF YOUR ACCESS TO THE SITE OR THE SERVICES.
THESE TERMS OF SERVICE ARE NOT EXHAUSTIVE AND HEALTHY HUMANS RESERVES THE RIGHT TO MODIFY THEM AND THE PRIVACY POLICY FROM TIME TO TIME, OR TERMINATE THE SITE OR THE SERVICES AT ANY TIME. ANY CHANGES TO THESE TERMS OF SERVICE WILL BE EFFECTIVE UPON POSTING THE REVISED TERMS OF SERVICE OR PRIVACY POLICY ON THE SITE. YOUR CONTINUED USE OF THE SITE OR SERVICES FOLLOWING THE POSTING OF THE REVISED TERMS OF SERVICE OR REVISED PRIVACY POLICY WILL CONSTITUTE YOUR ACCEPTANCE OF THE REVISED TERMS OF SERVICE OR REVISED PRIVACY POLICY.
3. Your Account and Your Data
The Site and the Services are limited to certain persons. One of the Services we provide is an account (“Account”) that you may use to store information about yourself (“Data”). You may not register as a user or open an Account with us unless you meet all of the following criteria:
1. You are 18 years of age or older.
2. You are and remain a resident or citizen of the United States of America.
3. You currently reside in the United States.
4. You are bound by and continue to be bound by these Terms of Services.
All other persons are welcome to visit our Site, but may not register or open an Account.
For each user who opens an Account, you are advised to keep your password confidential. Note that your user name is not confidential, and may be published on the Site and via the Services. Healthy Humans will assume that any action taken through your Account are actions that you have taken or that you have authorized. If you have reason to believe that someone has accessed your account without your authorization, you must immediately contact Healthy Humans (see “Contact Us,” below).
While Healthy Humans takes reasonable efforts to maintain the security of the Site and Services, we do not warrant that your Account cannot be broken into or that any security process that we use now or in the future cannot be broken or circumvented. Healthy Humans is not responsible for the actions of any computer hackers or any unauthorized access to or use of your Account, the Site or the Services.
You are solely responsible for the Data that is entered into your Account by you or any other person. You may only enter in the Account and use as Data the information that you own or have permission to use. By entering your Data into your Account, you grant Healthy Humans a license to store, process and use the Data with the Site and the Services, and subject to these Terms of Use and the Privacy Policy. You may give Healthy Humans permission to share your Data with third parties, such as health care providers, and your permission will remain in force until you revoke your permission by using our sharing notification process. Please note, however, that Healthy Humans may refuse in our sole discretion to connect with any third party at any time, and for any reason or for no reason. Healthy Humans is not a health care provider and is not a “covered entity” as that term is used in the U.S. Health Insurance Portability and Accountability Act (“HIPAA”). Healthy Humans is not subject to HIPAA, even when you choose to share your Data with your health care providers. However, other U.S. Federal and State laws may apply to your Data and your use of the Account.
4. The Site and the Services Do Not Provide Medical Advice and Are Not Medical Advice
The information provided on the Site and through the Services is provided for information purposes only. Healthy Humans’ information services do not substitute for professional medical advice, diagnosis, evaluation or treatment by a physician or other health care provider. Reliance upon any of the information on this Site or via the Services is at your sole risk.
Always seek and never disregard the advice of your physician or other qualified health care provider regarding a medical condition.
The information provided by Healthy Humans is based on available medical literature and physician opinions and has been reviewed by the Healthy Humans medical advisors. However, Healthy Humans does not warrant the accuracy, currency, or completeness of the information provided.
If you have a medical emergency, immediately call 911 (where available) or your doctor, or go to the emergency room of the nearest hospital.
Any reference on this Site or the Services to any specific commercial or medical product, process or service by trade name, trademark, service mark, manufacturer or otherwise does not constitute or imply any endorsement, approval, recommendation or certification by Healthy Humans.
5. Privacy
Healthy Humans respects and takes reasonable efforts to protect the privacy of its users. Healthy Humans has stated its information collection, storage and use provisions in its Privacy Policy, which are made a part of these Terms and Conditions.
6. Links to Other Internet Sites
At certain places on the Site and through the Services, you can access hypertext links to, or view Uniform Resource Locators (URLs) for, other internet sites. Other internet sites contain information created, published, maintained or otherwise posted by institutions or organizations independent of Healthy Humans. Healthy Humans provides the links strictly as a convenience to its users.
Healthy Humans does not endorse, approve, recommend, certify or control these external sites and does not guarantee the accuracy, completeness, efficacy or timeliness of information located at the other sites. Any use of any information obtained from such sites is voluntary, and reliance on it should only be undertaken after an independent review of its accuracy, completeness, efficacy and timeliness. Healthy Humans assumes no responsibility in any respect for the information contained on such sites, including (but not limited to) any errors or omissions, the accuracy or reasonableness of any factual or scientific assumptions, studies or conclusions, the defamatory nature of any statements, the ownership of any copyright or other intellectual property rights, and the violation of any property, publicity, privacy or personal rights of others.
Any references on any other sites to any specific commercial or medical product, process or service by trade name, trademark, service mark, manufacturer or otherwise does not constitute or imply endorsement, approval, recommendation or certification by Healthy Humans.
7. Disclaimers and Limitation of Liability

HEALTHY HUMANS AND ITS PARENT, PARTNERS, SUBSIDIARIES, EMPLOYEES, AGENTS, LICENSORS, CONTRACTORS AND AFFILIATES (COLLECTIVELY, “HH PARTIES”) MAKE NO WARRANTIES, AND HEREBY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, TITLE, ACCURACY, COMPLETENESS OR NON-INFRINGEMENT.
HEALTH HUMANS AND THE HH PARTIES ASSUME NO RESPONSIBILITY FOR, AND EXPRESSLY DISCLAIM ALL LIABILITY RESULTING FROM THE USE OF ANY INFORMATION ON THE SITE OR THE SERVICES, OR FROM THE USE OF ANY INFORMATION OBTAINED FROM LINKED OR REFERENCED SITES, OR FROM ANY SHARING OF DATA WITH THIRD PARTIES (COLLECTIVELY, THE “ONLINE INFORMATION SERVICES”). HEALTHY HUMANS AND THE HH PARTIES ARE NOT RESPONSIBLE FOR, AND EXPRESSLY DISCLAIM ALL LIABILITY FOR, DAMAGES OF ANY KIND (INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE AND EXEMPLARY DAMAGES) ARISING OUT OF ANY ONLINE INFORMATION SERVICES.
UNDER NO CIRCUMSTANCES SHALL HEALTHY HUMANS OR ANY OF THE HH PARTIES BE LIABLE FOR ANY AMOUNTS IN EXCESS OF THE LESSER OF (A) THE AMOUNTS PAID TO HEALTHY HUMANS BY OR ON BEHALF OF THE USER OR OTHER PERSON IN CONNECTION WITH ONLINE INFORMATION SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE DATE OF THE CLAIMED INJURY OR DAMAGE OR (B) $10,000. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE, INCLUDING, WITHOUT LIMITATION, BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION AND OTHER TORTS, REGARDLESS OF WHETHER HEALTHY HUMANS OR ANY OF THE HH PARTIES WERE ADVISED OF THE POTENTIAL FOR SUCH LIABILITY.
8. Copyrights and Trademarks
All material available on this Site or offered through the Services is the copyrighted work of Healthy Humans (© Copyright Healthy Humans, LLC), unless otherwise indicated. All rights are reserved by Healthy Humans. No material on this Site may be reproduced, modified, used in a derivative work, downloaded, disseminated, displayed, published, reposted or transferred in any form or by any means, except with the prior written permission of, and express attribution to, Healthy Humans. Notwithstanding the foregoing, an authorized user may download, but may not make any other use or distribution of, a single copy of material on this site for the authorized user's own personal, non-commercial use only, provided that the authorized user does not remove any trademark, copyright or other notices from the material.
HEALTHY HUMANS, HEALTHY BUDDY, WHOLE HEALTH PLAN, GET HEALTHY STAY HEALTHY and HEALTHY DASHBOARD and the face design are trademarks and service marks of Healthy Humans.
You are granted a limited, personal right to access the Site, and to read, use and print content on the Site and the Services for your personal, non-commercial, and informational use only. Your rights are non-exclusive and revocable, and may not be transferred, assigned, sublicensed or shared. You may not copy or distribute copies of the Site or Services, except for your personal, non-commercial and informational uses. Healthy Humans reserves all right not expressly granted in these Terms of Service.
9. Allegations of Copyright Infringement
If you believe that your one or more of your works has been copied on the Site or used in our Services in a manner that constitutes infringement under the U.S. Copyright Act, please provide the following information to Healthy Humans for receipt of notification of claimed infringement (to ensure that your notification complies with the requirement of the Digital Millennium Copyright Act, please see 17 U.S.C. § 512(c)(3)):
1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
2. A description of the copyrighted work that you claim has been infringed;
3. A description of where the material that you claim is infringing is located on the Site or in the Services;
4. Your address, telephone number, and email address;
5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
6. A statement by you, made under penalty of perjury, that the above information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

10. General Provisions
These Terms of Service and all uses of the Site and Services are governed by the law of the Commonwealth of Pennsylvania without applying any conflict-of-law principles.
Any dispute, controversy or claim that might arise between you and Healthy Humans shall be determined by one disinterested arbitrator in binding arbitration administered by the American Arbitration Association pursuant to its Commercial Arbitration Rules, the Optional Rules for Emergency Measures of Protection and the Supplementary Procedures for Online Arbitration. The arbitral award will be final and binding, and may be entered and enforced in any court of competent jurisdiction. The prevailing party in such arbitration will be entitled to reimbursement for out-of-pocket costs, including reasonable attorney fees.
11. Cancellation/Money-Back Guarantee
If you ever are not 100% delighted with your Stay Healthy program membership, for whatever reason, simply contact us within 30 days of purchase.
Along with your notice of cancellation, be sure to include your first and last name and Healthy Humans user name. Upon such notice of cancellation within 30 days of purchase, we'll promptly refund 100% of the unused portion of your monthly program fees.
